IRB Data Agreement

This IRB Data Agreement ("Agreement") describes how OralHistory.app handles research data collected under Institutional Review Board (IRB) protocols and the responsibilities of researchers using the Platform in IRB-regulated contexts.

1. Scope

This Agreement applies to researchers who use the OralHistory.app platform to collect, manage, or store oral history data governed by an IRB-approved protocol. If your research does not involve IRB oversight, this Agreement is provided for reference only.

2. Data Processing Role

For IRB-governed research, OralHistory.app functions as a data processor. You, the researcher (or your institution), are the data controller. You are responsible for ensuring that the use of this Platform is consistent with your approved IRB protocol and your institution's data security requirements.

The Platform's consent management system is designed to maintain an auditable record of narrator consent. Key integrity features:

These features support, but do not substitute for, the consent documentation requirements of your IRB protocol. Researchers must maintain any additional consent documentation required by their institution.

6. IRB Protocol Tracking

The Platform's IRB module allows you to record protocol numbers, approval dates, expiration dates, and amendment histories. This is a recordkeeping tool only. OralHistory.app does not verify the accuracy of IRB protocol information entered into the Platform and does not communicate with IRB offices on your behalf.

7. Data Export and Portability

You may export your research data in OHMS-compatible XML, JSON, and formatted text formats at any time. We do not restrict or withhold your data. Upon account closure, we will provide a complete data export upon request.

8. Data Breach Notification

In the event of a data breach affecting research data under your team, we will notify you at your registered email address within 72 hours of discovery, to the extent technically feasible. You are responsible for any further notification obligations to your IRB, institution, or participants.

9. Institutional Agreements

If your institution requires a formal Data Use Agreement (DUA) or Business Associate Agreement (BAA) as a condition of using external platforms for research data, please contact us at research@oralhistory.app before beginning data collection. We will work with your institution on appropriate documentation.

10. Limitation of Representations

OralHistory.app provides platform features designed to support research ethics compliance, but makes no representation that use of the Platform guarantees IRB compliance, satisfies any particular regulatory standard, or meets the specific requirements of any institution's IRB. Researchers are solely responsible for compliance with applicable ethics requirements.
